Virtual Try On Information Notice
L’Oréal USA, Inc. has instituted the following Information Notice related to Your use of a virtual try on feature. For further information about L’Oréal’s privacy please review L’Oréal’s Privacy Policy.
Purpose
The purpose of the processing and use of personal information for the virtual try on feature is to provide You with a meaningful, efficient way to evaluate products for potential purchase and use. When You use a virtual try-on feature, information is processed in order to deliver a better beauty experience to You. Please see “How It Works,” below, for more information.
How It Works
When you use the virtual try-on service feature it will download to your personal device and run and process data on your device or browser. You may use the live service (using your device webcam on a local device, such as desktop camera) or an existing picture (uploaded from your device). Your image will be processed locally on the device and (unless you choose to use the sharing feature described below) L’Oreal will not see or collect the images on your device or browser. L’Oreal may collect clickstream data about your use of the virtual try-on feature.
The virtual try-on feature will use an algorithm to analyze the picture to detect face landmarks to localize the region around key facial features (i.e., outline of eyes, lower part of nose, outline of lips, etc.). This information is used to digitally apply product to the correct areas and is not used to identify or verify the identity of any individual. Your image is not collected or stored by L’Oreal (except if you use the social sharing feature described, below), but the result of the experience (picture with product applied) can be downloaded on your device, and you may have the option to share it on social platforms using the service. You are free not to use this service.
Pictures are not otherwise collected or stored by L’Oreal unless you use the sharing on social platform feature (if available). In such case, the picture which has been processed to include the selected product is stored by L’Oreal for the time needed to achieve this purpose (up to 72 hours). The picture is automatically deleted after such period. By sharing your picture on social media, you are bound by the social media platform’s terms and conditions. If you share the result of the experience outside of the virtual try-on feature (through native features available on your device), we are not involved in nor responsible for such sharing and no further personal information will be processed by L’Oreal.
Your Consent For Collection and Use of Your Personal Information
When You use a virtual try-on feature, You specifically consent that:
The virtual try-on feature may temporarily collect, capture, possess, store, or obtain Your image, and data obtained or created from Your image (including the automated recognition of various facial landmarks), that might qualify as biometric data, biometric information, or a biometric identifier under various laws.
If You share Your information with a social media platform (if the option is available to you), the virtual try-on feature may share, disclose, or disseminate information about You from your device to the social media platform as needed to complete your request. You understand that when you make this request, we ( as well as to our service providers who store the image on our behalf) may store Your image for up to 72 hours.
YOU UNDERSTAND THAT YOUR CONSENT TO THIS INFORMATION NOTICE IS A PREREQUISITE TO USE OF HAIR COLOR VIRTUAL TRY-ON.
This Virtual Try-On Information Notice coexists with, supplements, and does not supplant, obviate, replace, or otherwise supersede or suspend any other policy applicable to Your use of a virtual try-on feature or a L’Oreal brand’s website, including the TERMS OF USE and GENERAL PRIVACY POLICY.
This Virtual Try-On Information Notice is subject to periodic updating, including to the extent that L’Oreal begins collecting personal information for any other purposes not specified herein. L’Oreal reserves the right to amend this Information Notice at any time, which amendments will further apply to Your use of a virtual try-on feature subsequent to their enactment.
Data Retention
This virtual try-on feature processes the photograph locally on the device. Once the information is displayed to You and Your use of the virtual try-on feature ends, Your image is deleted from the device or browser along with facial landmarks generated by the algorithm used to localize the region around key facial features. The image is not collected or stored by L’Oreal unless you use the sharing on social platform feature (if available). In such case, the picture the selected product applied is stored for up to 72 hours in our cloud platform. The picture is automatically deleted after such period. If you share the result of the experience outside of the virtual try-on feature (through native features available on your device), we are not involved in such sharing.
Depending on Your location, You may have the right under the law of Your state of residence to request deletion of, data about you at any time. In order to so indicate, You shall submit the request using the methods outlined in Our Privacy Policy.
If You request deletion of data about you, You understand and acknowledge that L’Oreal will keep a log of Your doing so, which log will include information such as Your name, date of request, manner of request, and date of fulfillment:
PLEASE NOTE that should You request deletion of data about You at a time when L’Oreal is compelled by law or order of court of competent jurisdiction to maintain such data, L’Oreal will not immediately comply with Your deletion request.
Data Storage
L’Oreal uses a reasonable standard of care to store, transmit, and protect from disclosure any data used in Product Name consistent with the sensitivity of the data. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure.
Disclosure
L’Oreal may share, disclose, or disseminate personal information with any other affiliated company or brand. L’Oreal will also disclose personal information to L’Oreal ’s service providers. L’Oreal may also disclose personal information to comply with federal or state law, local law, municipal ordinance, or court order, including in connection with a validly issued warrant or subpoena.
